Terms of Use
These terms apply to your use of the Chess Second app and its online services ("Chess Second"). Chess Second is developed and published by Muhammad Usama Aslam, an individual developer based in Pakistan who publishes under the name Intelgenic ("we", "us"). By downloading or using the app, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the app.
Who can use Chess Second
You must be at least 13 years old to use Chess Second. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you, including any subscription purchase.
Using Chess Second
We grant you a personal, non-exclusive, non-transferable, revocable license to use Chess Second on devices you own or control, for your own chess study. This license covers updates too, unless an update comes with its own terms. You may not:
- Try to break, overload or get around the security of the app or our servers, or get into other people's accounts
- Unlock Premium features without paying, for example by modifying the app, sharing one account among several people, or creating accounts to reuse free trials
- Sell, rent or redistribute the app, including APK or IPA files, outside the App Store and Google Play
- Scrape other people's data, or use the app to break the law or the terms of Lichess or Chess.com
We may suspend or close accounts that break these rules.
Intellectual property
The Chess Second app, name, logo, design and the ready-made books in the catalog belong to us or our licensors, and we keep all rights not granted to you here. Chess moves and openings themselves belong to no one. The Stockfish engine and other open-source parts stay under their own licenses (see below).
Your account
You don't need an account for the core trainer. If you create one, keep your sign-in details safe. You're responsible for activity on your account. You can delete it at any time. See Deleting your account.
Your content
Books, comments and notes you create are yours. When you back up or share a book, you allow us to store it and show it to the people you invite, only so we can provide those features. Only share content you have the right to share. Comments must not be unlawful, abusive or infringe someone else's rights. You are responsible for what you share, and we don't review shared books.
If you send us feedback or suggestions, we may use them to improve Chess Second without owing you anything.
Catalog books and links
Ready-made books in the catalog are study material. They may contain mistakes or comments we have not reviewed, and some may link to other sites. We are not responsible for content on sites we don't control.
Chess Second Premium
Chess Second Premium is an optional auto-renewing subscription. It unlocks building books from your games, Game Radar on new games, the advanced training modes, cloud backup and sharing. The core trainer stays free.
- Premium is purchased through the Apple App Store or Google Play. The price in your local currency and the billing period are shown in the app and in the store before you buy.
- Payment is charged to your App Store or Google Play account when you confirm the purchase.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
- You can manage or cancel your subscription in your App Store account settings or in Google Play subscriptions. Uninstalling the app or deleting your account does not cancel it.
- If a free trial is offered, any unused part of it ends when you buy a subscription.
- If the price changes, Apple or Google will tell you in advance and, where required, ask for your consent before the new price applies.
- Refunds are handled by Apple or Google under their own policies, not by us. Request one at reportaproblem.apple.com for the App Store, or in your Google Play order history.
- When a subscription ends, Premium features stop. Books on your phone stay yours and keep working with the free features.
- If Premium doesn't unlock after you pay, email us and we'll sort it out.
Third-party services
Game import, Lichess sign-in and some analysis features rely on Lichess and Chess.com. These services are run by others, and we can't guarantee they will always be available or keep working the same way.
Open-source software
Chess Second includes open-source software, including the Stockfish chess engine under the GNU GPLv3. Your rights under those licenses are not limited by these terms.
No warranty
Chess Second is provided "as is". We work to keep it reliable and your data safe, but we can't promise it will be error-free or always available. Engine evaluations and opening statistics are study aids and may be wrong. Keep your own exports (PGN) of books that matter to you.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of data, arising from your use of Chess Second. Our total liability is limited to the amount you paid for Chess Second in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law that can't be waived.
Changes to the app and these terms
We keep improving Chess Second, so we may add, change or remove features. If we ever shut down the online services or the app, we will give as much notice as we can in the app. Your books stay on your phone, and you can export them as PGN.
We may update these terms. If a change is significant, we will tell you in the app before it takes effect. If you keep using Chess Second after that, the new terms apply.
Ending these terms
You can stop using Chess Second at any time and delete your account. We may suspend or end your access if you seriously or repeatedly break these terms. When these terms end, your license to use the app ends too. The sections on intellectual property, liability and governing law continue to apply.
If you got Chess Second from the Apple App Store
Apple's Licensed Application End User License Agreement applies to your use of the app. These terms add to it, and if they conflict, Apple's agreement prevails. You also agree that:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Chess Second and its content.
- We are solely responsible for maintenance and support of the app. Apple has no obligation to provide any.
- If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone else's intellectual property.
- You confirm that you are not located in a country subject to a U.S. Government embargo or listed as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of Pakistan. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring a claim in your local courts. Please contact us first; most problems can be solved by email.
General
These terms and the Privacy Policy are the whole agreement between you and us about Chess Second. If a court finds part of these terms invalid, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms to someone else. We may transfer ours to a new owner of Chess Second, who must keep honoring them.
